This woman complained that someone put "Ching Chong Lee" on her store receipt, While everyone can agree that the comment was rude and racist, she is suing for $1 million. It seems like an insult to everyone who was actually physically or financially hurt because of racism.

I would like to get a million dollar payday for this kind of mental anguish.

Who was Ching Chong Lee?
Oh, okay.... apparently it was an actual famous person but a generic term for Oriental.

Wasn't there some famous radio traffic about an attack by PT boats that was aborted when they heard:
"This here is Ching Chung Lee, Now Don't You Put Those Fish In Me"?

Um, doesn't Intentional Infliction of Emotional Distress require some proof of physical injury? Did she get a headache or something?

State law tort regimes can be so weird sometimes -- I expect she is looking for an out-of-court settlement.

If someone would go out of their way to write a racist comment on someone's receipt, they deserve to get their nuts sued off. What was the perpetrator thinking?

It is probably a minimum wage employee who clearly is not too bright. I assume they woke up and said "I think I'll make an insulting racist comment to someone and provide them clear irrefutable proof!"

Actually, the potential for collaboration is very high here. I didn't see a picture of the employee here, just the CVS logo. Next time you are at the drug store, find some low level employee that doesn't mind losing their job, and promise them a 50/50 split to type "overweight middle aged white guy" on the receipt.

I am sure that will have them shaking in their boots. CVS will probably try to settle for $500 in "buy one get one free" coupons.

I agree that idiots should get their comeuppance, but god, do I hate our litigation society. Anytime anyone suffers the most minor of damages, real or perceived, someone's gotta get sued. I just hate it.
Be bold and risk defeat, or be cautious and encourage it.

I agree that litigation only feeds the lawyers, and makes everything more expensive. However, short of shackles, stocks, and the return of dueling, it seems the only way to effect change in our modern society. Everything is relative now, so without a sense of "common" decency, who can judge what is offensive?

What is the difference between writing on a receipt, spray painting the same message on a wall, or burning a cross on their lawn? Should we encourage the victim to, "turn the other cheek" each time?

The odds are in the case of "burning a cross on a lawn" the offender is punished. People rarely sue the offender, because in most cases that person has no money. You sue for money, so you sue the best insured entity that you can find. The attempt is always that the entity was not vigilant enough to prevent the actions of the employee.

BTW that phrase is probably misinterpreted. Most people assume it means to be docile and invite the person to hit you again. In reality it was customary to backslap an inferior so that the superior doesn't hurt his hand. To respond with aggression by an inferior would be sheer suicide. But "turn the other cheek" was more likely a statement to tell the superior to punch me like I was an equal. The more docile move would be to fall to the ground cowering. It is actually a "defiant" gesture, not a "docile" one.

If the superior was particularly aggressive, "turning the other cheek" would be met with more aggression, because it was not an acknowledgement of inferiority.

Protected classes can sue for any mistreatment under the pretense of racial motivation. I was at a casino buffet and saw the lawsuit coming because they were not seated in a booth, they could not physically fit into, yet saw the eyeballs moving planning to blame it on race. This story seems like a mnemonic device they got caught using in the receipt thing. If Michael Scott was still on The Office, they would probably have another episode where he reveals his unorthodox memory tricks.

You can tell all that by eyeball movements? You need to get into a hospitals were people have to painfully communicate via eyeball movements...
