And he'll be up working till 1 am. His old Butler says he does this every day. When he stayed at Mir a Lago the butler had to stay up till 12:30 in case Trump wanted something from the kitchen while he worked. If you take a risk, you may lose. Jun. 1937 5.39 years retire SCOTUS Willis Van Devanter appointed by Republican POTUS Taft 17. Jan. 1938 0.63 years retire SCOTUS George Sutherland appointed by Republican POTUS Harding 9. Jul. 1938 0.47 years died SCOTUS Benjamin N. Cardozo appointed by Republican POTUS Hoover 13. Feb. 1939 0.60 years retire SCOTUS Louis Brandeis appointed by Democratic POTUS Wilson 16. Jan. 1941 1.21 years retire SCOTUS James Clark McReynolds appointed by Democratic POTUS Wilson 4 March 1941 ---------- FDR begins 3rd term after landslide victory Bottom line is FDR's plan to pack the Supreme Court was announced after a massive landslide victory. The central provision of the proposed bill would have granted the president power to appoint an additional justice to the U.S. Supreme Court, up to a maximum of six, for every member of the court over the age of 70 years and 6 months. Members of both parties viewed the legislation as an attempt to stack the court, and many Democrats, including Vice President John Nance Garner, opposed it. The bill was held in committee for 165 days and during that time one member of SCOTUS retired. The bill was eventually defeated, but during FDR's second term, 6 SCOTUS vacancies (2 deaths, 4 retirements) became available. Out of the 6 vacancies 4 had been appointed by Republican Presidents. Bottom line if FDR had not been able to pack the Court after such a landslide victory, who thinks Biden would be able to if he wins? |

It was just a fluke that nobody retired or died. My guess is Trump will pick two more. Thomas is talking about retiring, he's 73 and Bryer is 82. They should really make 80 the retirement age, If you take a risk, you may lose. If you never take a risk, you will always lose. |

Age of Justices when FDR began his first term 76.3 Brandeis 73.9 Van Devanter 71.1 McReynolds 70.9 Sutherland 70.9 Hughes - 11th Chief Justice 67.0 Butler 62.8 Cardozo 60.4 Stone 57.8 Owen Roberts (only justice under age of 60 when FDR began his first term) In 1933 those men would have been considered fairly old. FDR ended up not picking a single justice in his first 4 year term. He appointed six during his second 4 year term. Owen Roberts for his last 1000 days was the only Justice on the Supreme Court who was not appointed (or, in the case of Stone, who had become Chief Justice, promoted) by President Franklin D. Roosevelt. Owen Roberts became frustrated with the willingness of the new justices to overturn precedent and with what he saw as their result-oriented liberalism as judges. Roberts retired from the Court only 16 weeks after FDR's death and his relations with his colleagues had become so strained that fellow Justice Hugo Black refused to sign the customary letter acknowledging Roberts's service on his retirement. Shortly after leaving the Court, Roberts reportedly burned all of his legal and judicial papers. |

If the Dems do win the Presidency and take the Senate, and do expand the Court (three BIG “ifs” there), I have no doubt the GOP will then add more seats next time they have the presidency/Senate.
