So I have an insane divorce case I am handling. As we were waiting for our case to be called, I noticed the other attorney talking to the Judge in the hallway of the courthouse. We were then called into chambers and seated with the Judge's law clerk, who normally handles the day-to-day operations other than trials. After the conference, as the other attorney and I were leaving, the Judge called the other attorney back in---judges are not supposed to talk to just one attorney on a case---so I started to go back into chambers as well—at this time, seeing me, the Judge waved me off, stating: "go away I don't want you" --so I protested and the clerk and the other attorney are yelling -- "don't worry it doesn't have to do with the case"--I yelled "there cannot be an appearance of impropriety" and they closed the door on me…

If they can't do that, can't you file a complaint?
It probably wasn't about the case, though. He
wouldn't be so blatant about breaking the rules.

I am filing a grievance and a motion seeking recusal of the judge
The standard is whether a reasonable person would believe something improper occurred

If it did, they were pretty brazen about it.
Is that common? They know the rules.

They say a good lawyer knows the law but great lawyer knows the judge

This is not a one time occurrence - it has happened once prior and I let it slide

I would ask the judge to recuse himself since its obvious the other lawyer is a personal friend.
