Even though those two sentences above look identical, if I sent one to one person and one to another, I would know which one was leaked as is, or even photographed in most cases. There's also many ways to protect and track information, even if it is not copied and just paraphrased by the person.

That is inciting. Many countries have hate speech laws (for example you can be arrested for making a racist comment.) There is no such regulation in the U.S.
