You have the kids back in my day who would get hold of mercury and play with it, watching it roll over their skin maybe, but this maybe harmed them but didn't kill them. If contained in a substance, it is potentially more deadly due to activation. The article says substance "containing mercury" so this may mean the victim is really in for it.

Based on what I read, it was going to be a dud. But if you attempt to harm someone even if what you're doing is not going to work like you expect, it's proper to get arrested for it. Not much of deterrence if you don't arrest people until their attempted crime actually succeeds.
