Trump has been threatening ‘civilian’ infrastructure like bridges and power plants. There are chants of ‘war crimes’ from a host of Democrat lawmakers. The court which arbitrates war crimes (neither USA nor Iran are members!) has interesting determinants of such. ‘Mixed use’ targets are ok as long as ‘proportionality’ is factored in. So if the bridge is used for tanks to go to the Straight of Hormuz is it ok to blow it up? If the power plant is supplying electricity to the naval base that is mining said Straight can we torch that plant? The only target that all seem to agree would constitute a war crime is a desalinization plant.

Interestingly, the scholars perceive just the THREAT against the civilian population of Iran is a war crime. I think Trump’s posts are clearly a threat against Iran’s civilian population.

I have mixed feelings about this topic. Basically, when at war your goal should be to win that war with as few losses on OUR SIDE as possible, and as quickly as possible. War is ugly. If we blow up a few ‘civilian’ bridges and that is the impetus for Iran to surrender/make a deal then I can live with that. I’m sure if there is a new regime we’d end up re-building those bridges for them.

Second question. If you are Corporal Joe Blow and you are given and order to commit what you perceive as a war crime, what are your legal rights/responsibilities? What can/should/would you do if you are told to blow up that desalination plant?
