First let me say that I have no disagreement wit SCOTUS opinion on removal of Trump from a state ballot. However in my opinion whether or not he was charged with insurrection is irrelevant. When the 14th Amendment was ratified there was no specific federal law defining the charge of insurrection. The federal law that could now be used to charge someone with insurrection (18 U.S. Code § 2383) was passed in 1948.

I agree fully, for the last two years people have said, "oh but no insurrection criminal charges...." Such charges did not exist until like WWIIish. So by that logic Jefferson Davis should have ran against Lincoln because he was not charged with insurrection. For most of U.S. history insurrection was an act without a precise (legal) definition, that you knew by looking at it.

It is without dispute that Trump engaged in insurrection activities. A formal charge is moot. If States should be able to use this to restrict ballot access is the debatable point.

If there was an insurrection, the protesters would have brought guns.

Most of the public knows it was a scam, which is why Trump is polling so good and why the J6 opinion polls reflect the scam.
