It will be up to a jury of his peers to determine if it was reasonable to think Pretti was an imminent threat when he was shot. That picture is NOT GOOD for the ICE guy.

My point is it’s ironic that they are using a picture where you can’t tell what’s in his hand as the poster for why he should have known it was a phone and not a gun.

This all started because of an illegal action by ICE
They didn't like the woman next to Alex
Weird and bizarre

They decide illegally assault the woman with physical violence.
Alex was simply helping the woman up when ICE went full gestapo
If the woman was doing something illegal
Why didn't ICE arrest her or call the police to arrest her
Why did ICE have to break the law with violent physical force????.
An illegal action by ICE started the whole incident
They escalated to the point of murder

It's a fascile point that has no relevance.

If they thought he was holding a dangerous object and it concerned them, they wouldn't casually walk over to him. And, he had the object removed from his hand before he was on the ground, so even after being in touching range, they still didn't realize it was a phone, is irrelevant, because he no longer had whatever weapon you claim they think it is.

We know it's a phone, they knew it was a phone. Even if it wasn't a phone, he no longer had possession of it. This is such a moot argument.

Also, they came to him because they were upset he was filming, and last I checked, you can't film with a gun...

Like, this argument falls apart in multiple ways under the slightest bit of scrutiny...

Could be somebody said "gun" when on agent removed it from Pretti and this triggered a knee-jerk reaction by another agent?

OF COURSE that’s what happened. Unless you really believe a man, being filmed by dozens, just decided to shoot someone in the head. (Apparently Gandler does!). These ‘cops’ are like you and me n more ways than you want to believe. They go to work everyday hoping to go home alive to their wife and kids. And not be in the news or possibly facing a life sentence in prison.

The guy who pulled the trigger misinterpreted the situation around him egregiously. Even if someone yelled ‘gun’ that doesn’t absolve you from using at least some judgment before killing someone. Will he be found criminally liable? I think so. Time will tell.

I only he left that gun home.
