He only has a case if they lied and knew at the time they were lying.
Just lying doesn't cut it. Not actionable. Only actionable if they knew they were reporting a lie

The capsule is estimated by experts to date back to 1887. According to the governor's office, records show that, "37 Richmond residents, organizations, and businesses contributed about 60 objects to the capsule, many of which are believed to be related to the Confederacy.

Yeah, and if you weren't arguing it just because you don't favor this one guy, you might have some idea what a terrible precedent that would set as the media could attack private citizens with an eye towards ruining their lives.
