I actually just found out today that he was an immigrant (from Iceland, who joined the Marines for citizenship,) not really relevant to this case, but just an interesting fact. I am embarrassed of the amount of crazy people who harass people on subways and trains and nothing gets done. Maybe he had the guts to do something because he did not grow up in American culture? (I have a feeling you do not see such people on Iceland trains.) |

I mean he is not really a vigilante, he was defending people on the train. It was just an unfortunate situation where he stepped up. |

The use of force as defined under Article 35 of the NYS Penal Code, is only justified when three conditions are met simultaneously. Any use of force in order to be justified, must be reasonable, authorized and necessary. Once Neely stopped resisting after being restrained by Penny and two other male passengers, the choke hold was no longer necessary. It was also no longer reasonable. His martial arts instructor from the Marine Corp testified Penny was taught that 'applying a choke would "render your aggressor unconscious," then Marines are told to release pressure immediately, otherwise it "could lead to injury or death." He meant well. He screwed up. He was lucky. He will lose the civil suit. |
